New York Strikes Back Against Climate Change: Holding Big Oil Accountable

New York Governor Kathy Hochul recently signed the groundbreaking Climate Change Superfund Act into law. This landmark legislation will require major oil and gas companies to contribute to a fund dedicated to building infrastructure to protect New York from increasingly severe climate disasters.

This act is a direct response to the anticipated rollback of environmental protections under the incoming Trump administration, which is expected to dismantle existing climate policies and weaken the Environmental Protection Agency (EPA).

How it Works:

The Climate Change Superfund Act is designed to hold the biggest multinational oil and gas companies responsible for their contribution to climate change. It targets companies historically responsible for over 1 billion tons of greenhouse gas emissions. The fund aims to generate $75 billion over 25 years, with at least 35 percent of the benefits going to disadvantaged communities. The state Department of Environmental Conservation (DEC) will establish guidelines for fund operation, including payment methods and infrastructure project eligibility. This initiative is modeled after existing state and federal superfund programs, but instead of cleaning up toxic waste, it will focus on climate resilience projects like upgrading stormwater drainage systems.

Projected Impact:

The act is expected to significantly reduce New Yorkers' future tax burden by $3 billion annually. This is crucial given that extreme weather events linked to climate change are projected to cost half a trillion dollars in preparation and recovery in New York by 2050.

Similar legislation is being considered or has been passed in other states like Vermont, California, Maryland, Massachusetts, and New Jersey, showcasing a broader movement to hold polluters accountable at the state level even in the face of federal inaction.
