New York County Bans Masks in Public, Sparking Controversy Over Safety and Free Speech

Nassau County, NY: Masks Now Banned in Public Spaces
Nassau County, Long Island, has passed a law banning masks in public places, with exceptions for religious or health reasons. This controversial law, known as the Mask Transparency Act, was introduced in response to a spike in antisemitic incidents, often perpetrated by masked individuals, following the Israel-Hamas war.
Proponents of the ban argue that it will combat crime during protests and allow authorities to identify individuals during traffic stops or when they have reasonable suspicion of criminal activity.
Critics: Mask Ban Threatens Free Speech and Public Health
Opponents, including the New York Civil Liberties Union (NYCLU), fear that the ban will discourage anonymous protest, making it easier to target protesters for surveillance, doxxing, and retaliation. They also point to the ongoing rise of COVID-19 cases in the US, arguing that face coverings are essential for protecting public health.
"Nassau County's mask ban is a dangerous misuse of the law to score political points and target protestors," said Susan Gottehrer, regional director of the NYCLU. "Making anonymous protest illegal chills political action and is ripe for selective enforcement, leading to doxxing, surveillance and retaliation against protesters."
A Divided County
The Mask Transparency Act was approved by a split vote, with 12 Republicans supporting the legislation and seven Democrats opposing it. It now goes to Nassau County Executive Bruce Blakeman for final approval.
"Unless someone has a medical condition or a religious imperative, people should not be allowed to cover their face in a manner that hides their identity when in public," Blakeman stated following the vote.
A National Trend?
This ban echoes similar concerns raised by New York Governor Kathy Hochul and NYC Mayor Eric Adams, who have both expressed interest in banning masks on public transit to deter crime. "On a subway, people should not be able to hide behind a mask to commit crimes," Hochul said.
