New York City's Taxi Industry on the Brink: Major Insurer's Insolvency Threatens Transit

American Transit Insurance Co. (ATIC), the insurer for roughly 60% of New York City's taxis, livery cabs, black cars, and rideshare vehicles, is facing insolvency, threatening a major disruption to the city's transportation system. ATIC has been the dominant player in the New York City commercial car insurance market for decades, offering lower premiums than its competitors. However, this strategy has led to years of warnings from industry analysts and mounting losses for the company.

In the second quarter of 2024, ATIC reported over $700 million in net losses, leading to concerns about its ability to pay claims. The company's reserves have been deemed deficient for years, with the problem intensifying as ATIC struggles to handle larger settlements and arbitration awards.

The potential failure of ATIC could leave tens of thousands of taxi drivers without insurance, creating a major crisis for New York City's transportation ecosystem. The New York Department of Financial Services (DFS) could be forced to intervene by placing the company in receivership or liquidating it.

“There is a perception that they are too big to fail,” said Andrew Don, chief operating officer of Research Underwriters, a transportation insurance broker. “If that happened, “there would be a large void in the ability to get a taxi or an Uber or a Lyft or a limo in New York as all of these vehicles would suddenly be without insurance.”

The potential collapse of ATIC could also lead to significant premium increases for drivers, further impacting an industry already facing challenges like increased competition and declining medallion values.

ATIC's underpricing strategy and failure to address its financial issues have raised questions about its ability to handle claims. Uber Technologies Inc. sued ATIC in February, accusing the company of failing to handle claims properly, resulting in lawsuits against Uber and its drivers.

The situation highlights the critical role of insurance in the city's transportation system and the potential consequences of a major insurer's failure. The DFS is currently working with ATIC and other stakeholders to address the issue and protect drivers, passengers, and the stability of the New York livery insurance market.
