Despite the issues, Copperfield continued to own the penthouse, offering a tour of the apartment to Galleria residents in 2018. Shocked by the state of disrepair, neighbors reported the apartment was in “disarray,” with bedrooms “upside down” and bathrooms covered in mold.

The latest lawsuit filed against Copperfield alleges that he abandoned the apartment in a “trashed” state, failing to maintain the property and allowing a valve to fail, leading to another flood in December 2023. The lawsuit further alleges that Copperfield has “allowed the unit to devolve into a state of utter disrepair,” leaving residents to contend with the consequences of his negligence.

Copperfield's attorney, Matthew A. Cuomo, dismissed the allegations, calling the lawsuit an “insurance claim.” However, the repeated incidents of flooding, the apartment's deteriorating condition, and Copperfield's alleged lack of responsibility raise questions about the magician's commitment to the property and his relationship with the building's residents.
