Following the partial collapse of a Bronx building in December 2023, the Department of Buildings (DOB) has issued a $50,000 fine to Arsh Landmark General Construction. The DOB's investigation revealed that the contractor should have identified and reported an error made by the engineer who mislabeled a crucial load-bearing column as purely decorative. This oversight, according to the DOB, directly contributed to the collapse.

Contractor's Negligence Cited

The DOB Commissioner, Jimmy Oddo, described the incident as an "avoidable, preventable tragedy." Deputy Commissioner Yegal Shamash emphasized the contractor's responsibility to review blueprints and identify potential structural issues. Shamash stated that the contractor should have questioned the engineer's designation of the column as non-load-bearing.

The contractor's registration has also been revoked, requiring reapplication to resume work in the city.

Systemic Issues Highlighted

The DOB Commissioner also pointed to broader issues within the city's building inspection system, noting a pattern of "crappy property owners, who tend to find crappy engineers, who tend to find crappy contractors." While miraculously no one was injured, the collapse left numerous families homeless and led to lawsuits against building owners for alleged harassment and neglect.

In response, the city has allocated $4.7 million for a new task force aimed at proactive identification and intervention in problematic construction projects.

Further Actions Taken

The engineer's license was suspended for two years following the incident. The city council also enacted new legislation to reform the DOB's inspection process. Despite attempts to contact them for comment, the contractor, engineer and property owner have not responded.
